Royal Princess Sweepstakes: Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THE FOLLOWING ROYAL PRINCESS® FACEBOOK SWEEPSTAKES (“SWEEPSTAKES”) IS GOVERNED BY THESE OFFICIAL RULES. BY PARTICIPATING IN THE SWEEPSTAKES, YOU ACKNOWLEDGE AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS STATED HEREIN.
Eligibility: The Sweepstakes is open to all residents of the 50 United States and the District of Columbia, Canada (excluding Quebec), and the United Kingdom who have reached 21 years of age or older at the time of entry. Void where prohibited. All employees of Princess Cruise Lines, Ltd. (“Sponsor”), its advertising and promotion agencies, Brandmovers, ,Site Systems, 48 Interactive, Paine PR, Amp, Optimedia, Facebook, and each of their respective parent companies, divisions, affiliates, subsidiaries, or agents (collectively, “Sweepstakes Entities”) and their immediate families (defined as spouse, child, sibling, parent, or grandparent, and their respective spouse) or household members are not eligible. Sponsor reserves the right to verify eligibility qualifications of potential winner.
Promotional Period: The Sweepstakes begins on January 15, 2013 at 12:00:00 PM Pacific Standard Time (“PST”), and ends on February 19, 2013 at 11:59:59 PM PST (the “Promotion Period”). All entries must be received by February 19, 2013 at 11:59:59 PM PST.
How To Enter: During the Promotional Period, eligible entrants (“Entrants”) can enter the Sweepstakes by accessing the “Royal Princess Sweepstakes” tab on the Princess Cruises Facebook Page at www.facebook.com/princesscruises (“Sponsor’s Page”) and complete the electronic entry form, including Entrants’ name, e-mail address, phone number and such other information as Sponsor may require. In order to be able to access the entry form on Sponsor’s Page, potential Entrants must first “Like” Sponsor’s Page. Entries must be received by February 19, 2013 at 11:59:59 PM PST. Entries become the property of Sponsor and will not be returned. Limit one (1) entry in the Sweepstakes per Entrant/email address/Facebook Account. All entries must have a valid e-mail address. Should multiple users of the same e-mail account enter the Sweepstakes and a dispute thereafter arise regarding the identity of the Entrant, the authorized account holder of said e-mail account at the time of entry will be considered the Entrant. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to Sponsor and not to Facebook. Any questions, comments or complaints regarding this Sweepstakes shall be directed to Sponsor and not to Facebook. Please see the privacy policy located at http://www.princess.com/legal/legal_privacy/index.jsp for details of Sponsor’s policy regarding the use of personal information collected in connection with this Sweepstakes. If you are selected as a winner, your information may also be included in a publicly-available winner’s list.
Winner Selection and Notification: Potential winner will be selected in a random drawing by an independent judging organization from among all eligible entries received on or about March 5, 2013. Judges’ decisions are final in all matters relating to this Sweepstakes. Potential winner will be notified by email, phone and/or express mail on or about March 5, 2013. Potential winner is subject to verification, including verification of age. Upon notification, if a Canadian resident, the potential winner must, unaided, correctly answer a time-limited mathematical skill-testing question. In the event that the potential winner is unable to correctly answer the skill-testing question, the Sponsor shall have the right to randomly draw another eligible entrant, and the Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. Potential winner may also be required to complete, sign and return an Affidavit/Declaration of Eligibility/Liability Release, and, where lawful, a Publicity Release within five (5) days of attempted notification or prize may be forfeited. If the potential winner is found not to be eligible or not in compliance with these Official Rules, or if prize notification or any prize is returned as undeliverable, the potential winner will be disqualified. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of Entrants.
Prize: GRAND PRIZE (1). One (1) verified grand prize winner (“Winner”) will receive one (1) 7-day Caribbean cruise (“Cruise”) for Winner and one (1) guest (“Cruise Guest”), sharing accommodations of one (1) double occupancy balcony stateroom (”Grand Prize”). TRANSPORTATION TO AND FROM THE POINT OF EMBARKMENT/DISEMBARKMENT IS NOT INCLUDED. All prize details not specified in the Official Rules will be determined in Sponsor’s sole and absolute discretion. Cruise includes all regular onboard meals and entertainment, applicable government fees and taxes for Cruise only. Cruise must be completed by March 5, 2014 or prize will be forfeited. All ground and air transportation, shore excursions fees, discretionary hotel and dining charges, meals in alternate dining venues, alcoholic beverages, boutique purchases, and any other incidental costs or other expenses not specifically set forth herein are the sole responsibility of Winner. All reservations and cruise arrangements including, without limitation, the dates and times are at the sole discretion of Sponsor. All Cruises must be taken during the time period specified; no alternative cruise dates are available or Grand Prize will be forfeited. All prize details are subject to availability and restrictions such as blackout dates including holidays (e.g. Monday, November 21, 2013–Sunday, November 27, 2013; Monday, December 19, 2013–Saturday, December 31, 2013) may apply. Cruise Guest must be 18 years of age or older as of the date of departure unless the companion is the child of winner. Minors must be accompanied at all times during trip (including, but not limited to, in-flight, hotel stay, cruise activities, and all other prize-related events) by minor’s parent or legal guardian. Winner and Cruise Guest must cruise on same itinerary. Cruise Guest must (or a Cruise Guest’s parent or legal guardian if Cruise Guest is an eligible minor in his/her state/province of residence) sign and return a cruise/publicity release before any ticketing of cruise occurs. The Winner and Cruise Guest must have all necessary identification and/or cruise documents (including but not limited to a valid passport, visa (if applicable) and all other necessary travel documents) required for Cruise. Once Cruise Guest is selected, they may not be substituted, except in Sponsor’s sole and absolute discretion. Cruise is subject to the terms and conditions of the Princess passage contract. As set forth in more detail in the passage contract, Princess reserves the right to refuse to embark Winner or any Cruise Guest, at any time if, in the sole opinion of Princess, Winner or Cruise Guest, or any minor or other person in Winner or Cruise Guest’s care during the cruise, are unfit for any reason for the cruise. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by Cruise operators or any other persons providing any Grand Prize-related services or accommodations. Winner and Cruise Guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Lost, stolen or damaged Cruise tickets, travel vouchers or certificates will not be replaced or exchanged. Unclaimed prize will not be awarded.
TOTAL ARV OF THE GRAND PRIZE: Up to $2,388 USD / $2,355.28 CAD / $1,479.74 GBP. Any difference between stated approximate retail value and actual value of prize will not be awarded.
General Conditions: Prize is non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Prize will be awarded only to an address within the United States, DC, Canada (excluding Quebec), or the United Kingdom. Winner will be solely responsible for all applicable Federal, State, provincial and local taxes connected with receipt of prize, the use and enjoyment of prize, or any other connection with this Sweepstakes unless otherwise required by law or unless this requirement is waived by the Sponsor in its sole discretion. If Winner is a U.S. resident, he/she will receive IRS Form 1099 for the ARV of prize. Canadian residents may be subject to withholding taxes and Canadian residents are responsible for the reporting and payment of any income tax. Prize values are based on conversion rates as of December 14, 2012 and may vary. As a condition of accepting the prize, Winner agrees to furnish any requested information needed for tax reporting. By participating in this Sweepstakes, Entrants understand and agree (and agree to confirm in writing): (a) to abide to these Official Rules which are final and binding and the decisions of Sponsor with respect to all aspects of the Sweepstakes, which are final, (b) to accept the prize as awarded, with substitution, and to release and hold harmless Sponsor, its parent, subsidiary and affiliated companies, advertising and promoting agencies, any other party associated with the development or administration of this Sweepstakes, Facebook, and all of their respective officers, directors, employees, representatives and agents (collectively, “Releasees”) from and against any and all liability whatsoever, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damages, loss or destruction of property rights of publicity or privacy, defamation, or portrayal in a false light) in connection with this Sweepstakes or with the announcement, acceptance, ownership, or use or misuse of prize (including but not limited to any travel related thereto) and/or use of the entry, or other errors in these terms and conditions and (c) except where legally prohibited, by accepting the prize, Winner agrees to the use of his/her name, photograph, likeness, voice, image and biographical information and statements for advertising, trade, publicity and promotional purposes without additional compensation, in perpetuity, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval by the Sponsor and those acting under Sponsor’s authority. Releasees are not responsible for loss, damage, or claims resulting from the Sweepstakes, including incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right to disqualify any Entrant or Winner who attempts to tamper with any aspect of the Sweepstakes, or circumvent these Official Rules. Entrants may not enter with multiple email addresses nor may Entrants use any other device or artifice to register multiple times or as multiple Entrants. Any Participant who attempts to enter with multiple email addresses under multiple identities or uses any device or artifice to enter multiple times will be disqualified and forfeits any prize won, in Sponsor’s discretion. Sponsor reserves the right to remedy any such action, disruption, or circumvention in a manner, determined solely by Sponsor that is fair and equitable to Sweepstakes participants. Sponsor reserves the right, in its sole discretion, to void, modify, terminate or suspend this Sweepstakes (or any portion thereof) should fraud or any unauthorized human intervention or other causes beyond the reasonable control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Sweepstakes. In the event of cancellation, Sponsor will award the prize from among all eligible, non-suspect entries received prior to cancellation.
BY ACCEPTING PRIZE, WINNER ACCEPTS (AND AGREES TO CONFIRM IN WRITING) THE INHERENTLY DANGEROUS NATURE AND RISK IN AIR, LAND AND SEA TRAVEL, INCLUDING PERSONAL INJURY AND/OR DEATH, ACKNOWLEDGES THAT HIS/HER PARTICIPATION IN THE PRIZE EVENT IS VOLUNTARY, ACKNOWLEDGES THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR AFFECT THE SAFETY OF THE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES THAT RELEASEES SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING INJURY AND/OR DEATH.
Laws in the Entrant’s country of residence may give Entrant the right to file claims before the courts of that country and may provide that some laws of that country are also applicable to this Sweepstakes. However, if any provision of the Official Rules or the application of any such provision to any person or circumstance shall be declared to be invalid, unenforceable or void, such decision shall not have the effect of invalidating or voiding the remainder of the Official Rules, it being the intent and agreement of the parties that the Official Rules shall be deemed amended by modifying such provision to the extent necessary to render it valid, legal and enforceable while preserving its intent or, if such modification is not possible, by substituting therefore another provision that is valid, legal and enforceable so as to give effect to Sponsor’s intent. If and to the extent that English law applies to this Sweepstakes, or to any dispute arising in connection with this Sweepstakes, nothing in these Official Rules shall in any way limit or exclude liability for or in connection with (a) fraud, or (b) death or personal injury caused by negligence.
Disputes: As a condition of participating, participants agree (and agree to confirm in writing), to the extent permitted by law: (a) to release Releasees from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, (b) that under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of California. Subject to applicable law, by entering, participants consent to the jurisdiction and venue of the federal, state and local courts located in Los Angeles County, California.
